His legal team have tried every avenue to avoid going to trial....They have delayed and obfuscated for years...They waited for the Obama admin. to take over, assuming that he would free the terrorists in Gitmo.Obama has pledged to close the detention facility, but he will still prosecute those terrorists (and that includes Khadr). Then his legal team hoped that the Canadian government would be defeated and a Coalition(comprised of the liberals,NDP and Bloc) would wrest power and demand that the U.S. release Khadr(didn't happen) .Then his legal eagles (or turkeys) launched a campaign in the media, what I call the EDNEY PLAN-you know ,bring Khadr back to Canada and let him undergo counselling,de-programming and all the other mumbo-jumbo etc...There was NO mention of Khadr facing trial but a form of supervised house arrest(Harper called it correctly-another P.R. stunt) .The government didn't buy that either! Now we have our activist judiciary trying to force the duly elected Government to demand the re-patriation of this terrorist scumbag...
Khadr is in the right forum to face his crimes, before a military tribunal and in the American Court system..Khadr will eventually get his day in court and the lawyers, despite their best efforts to avoid this scenario, will have to mount ....GASP!!!! a Defense!!!!
We have NO standing in this case, that is Khadr did nothing against, or in, Canada and we have no CURRENT laws under which to prosecute him...The Americans have him and they can F***ing well keep him...I hope that the Americans make a FEDERAL CASE out of our Toronto-born terrorist and THROW THE BOOK AT HIM!

Khadr is a Canadian citizen. As I understand it (and criminal lawyers amongst my readers are free to correct me), that means the Canadian government has jurisdiction to try Khadr for crimes allegedly committed anywhere in the world.

>I have to disagree, guys. Putting him on trial in Canada is the only >way to go. Having him sit in Gitmo just gives the >terrorist-supporting fifth column in this country more ammunition >for their propaganda.

Putting him on trial for what, exactly?

He left Canada and travelled to a foreign country where he allegedly murdered an American. Where do you see Canadian jurisdiction? I can see the Afghanis trying him because it happened in their country, or the Americans because it was one of their soldiers in a combat zone controlled by them...but why Canada? What's our interest here? Who claims to want him back except politicians looking to embarrass the Conservatives in any way possible?...

Kadr is not a soldier, of the child variety or otherwise, he is an unlawful combatant, and should be treated according to the Geneva Convention. That is to say he should be stood up against a wall and shot.

Rob, I've personally got no problem with throwing that charge into the mix.

The challenge will be making it stick. After all, Canada has signed agreements on the treatment of child soldiers.

But even if he goes free, it's still better than keeping this guy at Gitmo, as a martyr for his cause.

If that POS is brought back to Canada he should be charged with treason for fighting against Canadians and our allies .

All the boys at Gitmo have been in the American system for 8 years... and are still awaiting trial. If this was still 2001, I'd say what's the rush, but at this point, justice delayed (even for suspected terrorists) is justice denied. Clearly, the USA isn't up to the job of prosecuting unlawful combatants it picks up in foreign lands.

Not sure if we are up to the job of putting this to a trial either (so the lawyers can clear that up), but we are the only country allied to the US that hasn't offered to clean up it's own mess by taking our jihadis fighting in Afghanistan into custody.

We would have to wait our turn..he is already in the American 'system', and will be going to trial later this year.

He could drop dead for all care.

..same with his terrorist supporting family.Deport them all.
